Karina is a "Dreamer." She says she's not the only one.
The 22-year-old illegal immigrant and Montgomery College student spoke Wednesday at a news conference at the University of Maryland, Baltimore County to kick off Educating Maryland Kids, an effort to pass the Maryland DREAM Act.
"My mother has always told me that education is the path to my success and I very much believe that," said the woman who was only identified by her first name.
Karina, who plans on graduating next year with dual associate degrees in general studies and mental health, called for support for a bill that would grant in-state tuition rates to students like herself who are in this country illegally or are considered undocumented immigrants.
The law that would grant that opportunity will go before the voters in November after narrowly passing the General Assembly in 2011. Opponents collected nearly 109,000 signatures of registered Maryland voters, nearly twice the required number, to force the issue to the ballot.
Educating Maryland Kids, a coalition of groups including the Catholic church and other faith-based, education, civil rights, and labor unions, kicked off its efforts to educate voters and uphold the recently passed tuition bill.
"The Catholic church supports the DREAM Act because we believe that every person, regardless of their legal status is a child of God," said Bishop Denis Madden, Auxiliary Bishop for the Archdiocese of Baltimore. "As a church and as a community, we flourish when we strive to provide the opportunity for every person to reach their full potential and to develop the unique God-given gifts that they have been given.
"We are convinced that when Marylanders know the facts about the DREAM Act, that they will happily embrace the chance to do the right thing for our young people," Madden said.
Del. Pat McDonough, a Middle River Republican and a leading opponent of the law, said the coordinated effort to support the law is not a surprise. He said opponents will not be able to match the money he expects groups like Educating Maryland Kids to spend before the election.
"We don't have O'Malley money, and we don't have SEIU union money, and we don't have any angels saying, 'Here's some money, go out and tell the truth.'" McDonough said. "What we have are people across the state who believe this is wrong."
McDonough plans to hold his own news conference Thursday in Middle River—an unofficial kick-off to defeat the measure, he said.
The Republican delegate Tuesday criticized Freeman Hrabowski, president of the University of Maryland, Baltimore County, for attending and speaking at the event.
"He's a public official and his salary is paid for by the taxpayers of Maryland," McDonough said. "What right does he have to advocate for breaking the law?"
The University System of Maryland has twice voted to support the law.
Hrabowski said the event, even though it was held at his university, was not a university-sponsored event—though he said he personally supports the effort.
"As an american educator, I have a special belief that the more we can do to educate the children in this country, the better off our country will be," Hrabowski said. "In fact, I would argue that it is our way as Americans, to believe in our children.
"Children need to know that adults believe in them and that they appreciate the power of of education to transform lives. Where would we be without an education?"

Why not start a private foundation to raise funds for helping these kids go to college. If the catholic church and private citizens believe in this cause, they can send in their checks. From one Independent to another, only a complete fool would remove Dr. Hrabowski from UMBC. He is one of the best university presidents in the country, probably the most hands-on, available and public representative of any college in the land. Because Dr. Hrabowski takes a stand on an issue that benefits his institution and society, but places a small burden on state residents with which you disagree is, indeed, a very foolish reason to remove him. This is not Virginia, we don't give ultimatums to our university officials to take positions against their own best judgements for their students and their institutions because of our own selfish interests.

Explain to me how the removal of President Hrabowski, a dedicated educator and believer in children as the future, would have any positive effect at all, either towards your clouded cause, or against the DREAM Act. How many people have appliances delivered, or contractors who only "one" speaks english? I have been told by business owners that the one that speaks english is legal while the one that cant speak english is illegal, I saw the same with contractors tree removal during the aftermath of the storm that left us without power Some business owners have to use the same tactics to survive. I know one that employed several; the group will get an apartment work and send money to there home country or move family to create the anchor . Its all about money and control!

I would love to see more information on what type of financial aide these illegal immigrant students are receiving. I'd also love to know how illegal immigrants are paying taxes if they are here illegally???? How are they obtaining jobs without the proper I-9 documentation? My white male straight A, prep school child could NOT be admitted to UM because of overcrowding...he needed to be 'diverse' and come from a non working family...went out of state with a 50% academic scholarship that worked out far cheaper than Maryland with a better program. The CITIZENS that do it 'right' continue to be punished....ENOUGH! Community colleges should be the entry point and the Universities the goal. Lower degrees can earn the way into a four year program via hard work. No one is saying that these illegal aliens cannot go to college in Maryland. The current referendum simply suggests that it just doesn't make any sense to subsidize their tuition, with the taxpayer's money, especially at a time when our state officials are already spending more than we take in. Combine that with the fact that these same legislators are running people and businesses out of the state with their ridiculous taxes and regulations, and the revenue influx becomes even worse. Maryland does not need to find new ways to spend the taxpayer's money. It needs to find ways to cut spending before all of the motivated job creators leave the state.

The MoCo county councilmembers continually give money to illegals, have been on the board of directors for casa of md. Steve, you apparently have NO idea what the college admittance requirements are now. Good grades and SAT scores are NOT enough. You need to have lots of extra-curricular "stuff" (activities, volunteer work, job, whatever) AND fit in with the population quotas for the school (so many whites, Asians, blacks, etc., and then so many of each sex in each race plus other factors, such as family income (certain percentage from disadvantaged backgrounds, for instance), etcetera, etcetera, etcetera to quote the King in The King and I.
Once you have that, there is the percentage of students that are in-state and receive the lower tuition rate vs. the number who are out of state and pay the higher rate. Every illegal who gets in-state tuition takes away an in-state tuition slot from a legal resident.
If Jay's kid "didn't have what it takes", it very likely was not in the grade department but in the ethnic/social/residency department. I know 5 students with high GPAs who graduated from Maryland high schools last year who College Park either wait-listed or denied outright. Their SAT scores were all over 1850 (3 were over 2000). We are chasing some of our best students out of state.
I'm sorry that they are here illegally because their parents brought them here as children and the children didn't have a say in it. However, this is NOT my fault and I'm NOT willing to pay for it. No one is denying these children an education; we're denying them the lower tuition rate.

I work with 3 guys, each from the same Central American country. They all came here 2 decades ago speaking only Spanish, sporting dark sun-kissed skin, black hair...you know the pretty typical looking latino. Each has become a USA citizen, learned English, and speak it proficiently. They work hard and are productive employees. Each have sent back for family members and have waited patiently for their legal arrival while they were processing their imigration papers. Each on of these guys despises foriegners who skirt the law and enter illegally. They each oppose the Dreamers desire for special exception. Are they racists too, or is it just those folks you suspect of being white non-latino males that qualify for this label?

Chillin, that is exactly the case in point. Family friends of ours since 1982 are from south america. I even vouched for the husband when he wanted to become a citizen, His visa ran out after his family returned to South America and he wanted to stay. They also have many friends from south and central america, mexico, etc. They are ALL here legally and detest those who are here illegally and cry for "their fair share". They do not like the way illegals are treated in MOCo and get their handouts every month when they work hard, have businesses and vote republican every time.

We spend entirely too much money subsidizing higher education, not just for illegal immigrants but citizens as well. College is an investment. If you're not worth the investment in yourself, then don't go. If you are worth the investment, then your parents need to scrimp and save to pay for it, or you need to take loans with the understanding that your higher income from your schooling will pay it back.
When did this country become a bunch of losers who expect someone else to pay for your college? And most of what taxpayers end up paying for are worthless liberal arts degrees anyway. Students: the world doesn't owe you a thing. Anything you want to have to work hard for it.

Ohai, we could have an entire discussion thread on why the cost of of college is so high, but I personally think one huge contributing factor is the availability of student loans. The cheapest 4 year colleges that we've looked at for my daughter will cost $20K/year for tuition, room, board, books, fees, etc. They only go up from there and total costs in the low to mid $30K range is not unusual, especially at out of state schools. If a student and his/her parents had to pay cash for these schools, colleges would not be able to increase their costs by $1,000 or more a year every year (for everything, not just tuition). With these costs and the lack of a good job market for graduates (even some with science, computer science, engineering, math, etc., degrees), college is quickly becoming a BAD investment.
As far as subsidies, if it makes you feel any better, in April, 2011, the legislature started phasing out the Distinguished Scholar Program. New students are not being accepted into this program, which benefited students with a record of higher academic achievement. This is just something else that is sending our smarter kids to out of state schools that offer them a better aid package, including a tuition discount based on their grades and SAT scores. Once they go out of state, there is a good chance that they will stay there and not bring their brains and abilities back to Maryland.

Shouldn't the state also provide the gift of a new car, besides it will cost less to provide a car then having he or she miss classes and fail out of college. Good point you brought up John. One of my best friends works for Ride on and he tells me that over 70% of riders on ride on are free. Alot of them are those that are here illegally. I support letting the elderly, students (during scool hours) handicapped, etc, but not illegals. They are NOT allowed to voice their opinion about it and the taxpayers of Montgomery County have to support it with our taxdollars. But it is ok for legget to take away our services that we pay for, like ambulence service. Stevie, Frank Jag and others better not have a heart attack, they will not have an ambulence to ride to the hospital in, since they would not be able to afford the $600 cost for the ride.

You miss the point that these are also TAXPAYERS that we are talking about. In-state tuition is not a "discount," it's a lower rate based on the recognition that our tax dollars already go to support our state schools. The DREAM Act is not some kind of handout to freeloading "illegals," it's simply an extension of that same lower rate to people who ALSO already pay taxes to support those schools.

We are talking about illegal immigrants (or undocumented workers, if you prefer). They need "documents" to work. All employers must fill out I-9 forms proving an applicant is permitted to work in the USA. In order to fill out this I-9 form, the employer must see proof they are legal. Any employer who hires people without first completing this I-9 form risks paying thousands to tens of thousands of dollars in fines.
It is easier (and cheaper) to pay the "undocumented workers" under the table, withholding no taxes, and paying no employment taxes. When this is done, how does the illegal immigrant file a tax return?

Facts matter:
All undocumented students eligible for in-state tuition must attend a MD high school for a minimum of three years and graduate from it, earning college acceptance by way of achievement.
Students' parents must show proof of tax filing -- undocumented workers can and do pay taxes and parents must show evidence of this before their children will be considered for in-state tuition. (To date, out of 11 states with the Dream Act in place, MD is the only state requiring this.)
Qualified Dream Act students are considered for acceptance from the same pool as out-of-state applicants. Maryland residents are not affected by this law. If your "white, male, straight A prep school" son didn't get accepted to the state college of his desire, it certainly wasn't because a nonnative took his place. (And get over your White Pride, while you're at it.)
Dreamers must first attend 60 credit hours at community college before beginning their program at a state university.
These students must commit to working toward US citizenship.
Dream Act candidates must be fluent enough in English to attend classes in English and will not be enrolled in ESOL or EFL programs.
Less than 1% of college students will qualify for the Dream Act, making this law a non-issue in terms of alleged overcrowding on state campuses.
I think we can all agree that the immigration system is broken, but we can't wait for congress to fix it. It's only fair that we allow full access to education for all.

Or if you had played sports you would understand departmental budgets. Real simple FIFA, colleges accept admissions based on in-state, out-of-state, and scholarship/grants to prepare their budgets. If you take out-of-state spots with illegals instead of usa citizens, you are causing a budget shortage in the form of tuition payments. Do you think that the president, dean, academic advisors, or even coaches and athletic directors are going to take a paycut because of that? No, instead what will happen is that university will raise tuition on everyone and ask for more federal and state dollars which is supplied by taxpayers. The SCOTUS ruling from a few weeks ago that struck down Arizona's SB 1070 made it clear that immigration law violations are a civil matter, not a criminal one. No one is going to argue that a Maryland kid shouldn't get in-state tuition at a Maryland public university because his parents racked up a bunch of parking tickets, or operated a business without the proper license.
Or, even if for the sake of argument we pretended that immigration law violations are just the same as whatever horrendous crimes you want to imagine, no one is going to argue that the Maryland children of those who committed those crimes should be denied Maryland in-state tuition because of their parents' crimes. It doesn't work that way and never has.

Sorry Matt, but the SCOTUS decision did nothing to change the deportation of illegals for being what? Oh yeah, they are illegal. It only prevented the state itself from enforcing the law. However, once they are detained and given a chance to produce papers they can be summarily sent to ICE and then a deportation order can occur. Andrea, you need to learn more about tax laws, such as how many people actually pay taxes once all the deductions & credits, including the earned income credit, are taken. Just because employers deduct taxes doesn't mean they aren't ultimately all refunded to the employees after the tax return is filed.
The Dream Act is not fair to anyone except the illegal aliens - we'll disagree on this one.
Your facts are all from groups in favor of the Dream Act & thus spun to suit their agenda. Try getting some from sources opposed to the Act. I didn't attend the meetings you reference, but I did check out the website for Educating Maryland Kids to see if they could change my opinion; they did not. I'm sure the TESOL group is in favor of the Act given the nature of their work & I know about the Industrial Area Foundations and saw no reason to seek out their material.
Ethnic origin DOES play into college acceptance & if you don't know that, you are unfamiliar with the current "diversity" movement on most college campuses. There may not be official quotas but there are definitely goals for having a diverse student body. I'm not saying that is right or wrong; I'm simply saying "it is". Don't believe me? Go to the home page of any public college or university and enter the word "diversity" in the search box. You might find a couple where you don't get multiple hits, but for most schools you will get a plethora of articles and probably a link to the "Office of Diversity".

"Poverty Credit" is applied when an individual's/family's income is so low they qualify for a full tax refund -- this applies to all low wage earners, regardless of race. And I'm fully aware of diversity movements on campuses because I am currently in the throes of a college hunt with my own child, north and south, coast to coast. My child will undoubtedly be denied admission to certain colleges for various reasons, and I don't begrudge accepted students and blame them and their families for my child's denial. Diversity is a buzzword that means many things other than race. My point is that my whiteness (and the previous author's) does not ensure me favor in society -- I am not entitled to any more or subjected to any less because of my light-colored skin. But what I will always support is providing opportunity to members of my community who have the cards stacked against them.

I believe this is the final language in the bill that was passed and signed by the governor.

The law does not say anyone must pay taxes. That was the ORIGINAL bill but git taken out and reworded to 'must file taxes' and enen then may file back taxes if they never filed to begin with for those years required. That opens the question, will they then get a special break form the IRS for not filing taxes when they had income to declare? Will the IRS give them a benefit you or I would not get if we didn't file taxes for 5 years then filed 5 years of back taxes?

My wife and I are fortunate that we have well paying jobs in the private sector. We both would do much better financiaciaially if we moved to another state. Unfortunately we are morally committed to take care of elderly parents and choose to stay in Maryland and suffer the perversion of the system. The Maryland upper education system is totally perverted. We use our tax dollars to build these grandiose campuses and then limit the number of Maryland residents that are accepted and give preference WTO out of state student eats that pay a higher tuition rate. How wrong is that? We pay exhobantly high tax rates to support building a good college system then exclude md residents in favor of out of state students that pay a higher rate?.
That is so wrong!!!!!
Can md continue this extortion of. Higher tax rates and lower delivery of services to tits tax paying residents. Are we just to pay the bill and shut up?

Steve - I can't speak to others, but I'm not old - I must confess I am white. Most of my friends are middle aged white and black middle class working stiffs and next to none of them support this. Maybe its because we are all kids of WWII vets who worked their asses off. Nothing was handed to them and they worked two jobs to send most of us to college. At some point we have to systematically dismantle the incentives that we provide that encourages illegal immigration. Since it simply isn't feasible to send them back, maybe we can stop making it so tempting. If the folks coming here knew that they wouldn't receive free healthcare, education, and cash work they would think twice. I recognize that the kids in question are not here because of anything that they have done; however, I simply can't justify another tax funded entitlement. This could be taken care of through private donations or sponsorships if people believe in it that strongly.

First though, I have a real problem responding to anyone that is a Birther (that is not name calling, it is a person that believes President Obama was not born in Hawaii). John's irrational thought process that arrived at his Birther beliefs results in my giving him zero credibility on any other political issue.
That said, supporters have absolutely no problem allowing students in-state tuition rates for numerous reasons:
1) the students came here because there parents forced them, some were infants.
2) the students must enroll in a community college first and complete 60 hours prior to attending a four year school. Thus they would transfer as a junior subject to the same entry standards as anyone else. For the most part, junior transfer openings exist at almost all 4 year colleges.
3) No different than other people, they must prove their "residency" in the state by parents filing 3 years of income tax returns.

4) There is no cost to taxpayers. Opponents like to measure the difference between in-state and out-of-state rates and multiply that by the proposed number of students to come up with a cost. However, community colleges and four year colleges have empty seats, thus any money paid by these students is extra revenue with very minimal cost. If forced to pay out-of-state rates many students will not be able to afford college and not go.
5) Their parents pay gas taxes, sales taxes, and many other fees and costs.
6) If they have not filed tax returns they don't get the in-state rate.
7) The realists understand that the choice to send back 11 million people to wherever is not a choice at all, it is not going to happen no matter how much they wish for it.
8) So our choice is simple, encourage education or discourage education, I'm for education.

Wow. The comments in this post are everything that is wrong with the political arena today. People can't have an intelligent debate without it quickly devolving into insults and wild rhetoric.
No wonder I'm an Independent.
For the record, since I still want to chime in my opinion, I think the DREAM Act is unconstitutional. I don't think anyone's a moron for wanting to support it or oppose it, I just personally don't think it should be legal. My wife used to work for an immigration and refugee aid organization and our hearts are with the millions of people trying to legally immigrate through the incredibly broken system that is U.S. Immigration, but at the same time offering special state-sponsored tuition aid to someone here illegally, regardless of how they got here, doesn't strike me as constitutional.
Many of the kids who'd be seeking this aid were born in this country or came here when they were so young that they had no say in whether or not they crossed into the U.S. legally or illegally, but that doesn't change their status. It's a crap hand to be dealt in life, but as slow and incredibly asinine as the system may be, there are ways to change your status and those should be sought before a person can receive the same rights and benefits as a citizen.

Just so we're clear - they are not receiving "the same rights and benefits as a citizen" in the case of the Maryland DREAM Act. In fact, they are receiving distinctly lesser rights because, unlike typical Maryland student citizens, they are forced to undergo far more stringent requirements. Some of those requirements include the student and the parents submitting tax returns, the student attending community college first, and the student obtaining an Associates degree. A regular citizen of Maryland has none of those requirements.
As for constitutionality, I'm curious which specific section you would point to that bars a state's citizen's from changing tuition requirements for students.
I do agree with your opinions (or rather, direct observations of truth?) as to the level of discourse in this thread.

Reading through the threads on this topic I am bowled over by the hate, ignorance, and incivility. It is amazing how disturbed some people get when they believe that someone is benefiting from the law when they are not. Several of the commenters, from both sides, make excellent points. Unfortunately, few are listening or willing to give credence to what was said. The issue of the Dream Act is an issue that deserves real analysis and mature discussion. For all of the derogatory and divisive comments, the issue really affects a lot of people - both directly and indirectly. These children may be students today but they will be American citizens in the near future. I too am concerned about immigration. I'm not happy that Congress will not fix what's broken, will not provide the funds needed to manage the current immigration law effectively or, for that matter, protect our borders. Obama, and Bush before him, manage the programs that Congress created and fund. While each as President determines program priorities, they do so within the laws governing those programs and the funding provided. Whether we wish to recognize these children as Maryland residents will be left up to the voters, a proper process in a democracy. We should however at least recognize that these children were raised as Americans, many only speak English, they were educated in our schools, and when they enter the workforce they will contribute to our society by the work they perform and the taxes they will pay.

They have plenty of articles to explain what they believe and the basis of their beliefs, I mentioned only two to help place their drivel in some perspective. There are plenty of web sites, radio stations, and periodicals that spew lies, hate, and distortions of fact and history whether it is politics or religion. Some people are drawn to them because they provide simple answers to complex issues, others are attracted to them because they hear the echo of their own distorted view of the world. You don't even need to look hard to find them. And, you sir, found a gem. There are many more like it. You say, "open minds ask questions seeking truth." It may be useful to follow your own advice.

I want to thank all of you who actually provided urls that discuss your points in greater detail. The FAIR site, provided by B Allen, was very interesting and had some good information - I also read their report indicating that 74% of the $1.9 billion is due to education costs. Of course these costs have nothing to do with Republican or Democrat ideals, they are required under international obligations for human rights (education and health). While there is more fact than fantasy at the FAIR site, there is indeed some fantasy associated with their assumptions. But even if racism is their motivation, as the link provided by Steve indicates, the information provided is useful. B Allen's url about the Venezuela International Book Fair discussion is meaningless, it must have been a slow news day for the socialist newsweekly to even cover it. I'm more impressed that B Allen found it as I would discount just about anything the publisher printed - but it does take perseverance to search out relevant facts. Corbin Dallas Multipass provided some useful urls though not nearly as entertaining as some. I did get a kick out of the Potomac Tea Party Report. Unfortunately other than cost, which is important, none of these really help me understand the issues. Only the FAIR report provides an estimate of $12 million per year for the costs of DREAM. As budget items go that's inexpensive. I guess it depends whether it's an investment or a cost.

Michael, it is a well known fact that in MoCo, they have been supporting illegals for years. I don't nkow how you came up with the "racism" factor, unless you believe what the left wing nutjobs throw out there, but racism has NOTHING to do with it. I know people here illegally and they get ALL "freebees". One woman who I totally adore and her daughter and my daughter are good friends, has been here now for 16 yrs illegally. She does not work legally (10 hrs a week or so cleaning houses for a couple of people and gets paid under the table), has 3 children and a nephew. She told me she gets her townhouse, health needs, welfare for food, the kids get reduced meals at school, utilities all paid for by Montgomery County. Hell, she even has cablevision and had a HDTV 5 yrs before I bought one. She pays for the cable and bought the TV on the wefare money she gets. NOW IS THAT FAIR TO ANY MD TAXPAYER WORKING HARD EVERY DAY AT A FULL TIME JOB? If you think it is, then maybe you need to move to Greece or Spain or Venezuala and get their socialist handouts.

Michael, when our taxes are raised more and more, our services are cut back more and more. When more and more income is given to people here illegally and it does not matter where they are from, it is NOT an investment. It is a burden on ALL taxpayers in MD. The monies that illegals will not have to pay take those dollars away from the taxpayers. I say fill all those positions with out of state students and that will bring more money into the higher educational system. Also, it has been a known fact for years that taxpayer dollars pay for people here illegally. Just look at what Ike Leggett did when he got elected. He went back on a promise, thumbed his nose at the MoCo residents and used taxpayer dollars to build "day labour" sites, when the people of MoCO siad they did not want taxpayers dollars to be spent on that. Let's assume for the moment that we actually fully fund the government's immigration, customs, and border security programs to do what we say we want done. What will that cost us in taxes? How much larger will the government need to be to ensure zero tolerance? Let's assume that no new undocumented foreigners are able to overstay their visas or are successful in getting into the country. What do we do with the undocumented workers who have been here 5-10-20 years and more? Are we going to deport the parents of U.S. born children? What about the non-U.S. born children who only know life as it is in America? And, if they are going to stay do we want to welcome them or treat them with scorn? The issue about cost and investment with regards to the DREAM Act has to do with our future. These young adults, whether they go to college or not, whether they get a break on the college tuition or not are going to remain in the U.S. I have been taxed all of my working life to pay taxes for your children's education and simply put, I do not feel I got my money's worth. When I hear about how some children crave an education, understand the value of education, and are willing to jump through arbitrary hoops to get an education, I tend to be sympathetic. But sympathy doesn't translate to paying more in taxes or getting less of something else as an offset.

Steve, I read the "FAIR" report and yes it has several poorly supported assumptions throughout. But the basic logic provided is sound. It is saying that if our past immigration control had been perfect so that there were no illegal immigrants, we would not be paying $1.9 billion annually for the support of illegal immigrants or their children. That is indisputable, if there were no illegal immigrants, there would be no children, etc., etc. But it does not address the reality that exists. Immigration control and border security will never be perfect, so how do you address the status quo? This is a question that every nation addresses on a regular basis. Most civilized nations seem to address it differently than those less civilized.

I don't speak Spanish and the only English sites I found on La Raza spoke of justice, racial pride, and one site that hinted that it was racist. Wikipedia indicates the term has been used to indicate ethnic pride, but I found no movement or coordinated efforts regarding La Raza. Wikipedia also states, "In Latin America, depending on the location, it may primarily emphasize Spanish and European heritage, and/or the family, such as the name Dia de la Raza to mark the arrival of Christopher Columbus to America. In other Latin American contexts, it is used more expansively to describe the race formed by the fusion of White people, Native American and African peoples in Latin America. In this way, "La Raza" symbolically means "the people"." But I tend not to base my judgments on Wikipedia. Please provide me more information. And tell me how La Raza figures into any of this.

I think its great that such groups can celebrate their likeness but it often does so from the perspective of victim. I believe that this is basic human psychology and group behavior. By defining themselves in contrast to others it may create a sense of "them and us" which is not helpful for them or us. We see it in the ugliness of the current party politics where it is more important to ensure that the other party fails than that we all succeed. We see it in religion and even in economic classes. There is much to be proud of in Latino, African, European, or any other heritage, but in the end each individual must be true to themselves regardless of group identification. Each individual must determine how best to move forward.

Escariot, I don't understand the point you're trying to make. There was a law suit filed in court in 2008, it was dismissed. It was filed by the same person who filed suits against President Bush and Vice President Dick Cheney, claiming they knew about the Sept. 11, 2001 prior to the attack. There are many frivolous lawsuits filed regularly. The fact that it was filed by H. Clinton's former attorney appears to be more about a grudge than anything else. I don't understand how this is an issue here. Also having questions about Obama's birthplace may have been appropriate at one time, but when even the State of Hawaii has confirmed multiple times his birth there, then believing the opposite does open one to some derision. The same derision I hold for anyone believing that President Bush knew that the Twin Towers were going to be attacked. Doesn't make them bad people, just something is not right with them.

Saying a lawsuit took place because one was filed and dismissed is like saying a party occurred just because you sent out invitations but then cancelled it.

Sorry Corbin, but your statement is not how real life works. Even though dismissed, that lawsuit was the first formal challenge to barack obama being a us citizen and thus having the legal right to hold the office of president. That challenge came directly from the camp of hillary clinton, who is now the secretary of state. So in effect, for people like frank and steve and fifa to criticize birthers, they also need to criticize the entire clinton democratic machine for its origin. Hypocritically, they do not do so. Also sir, you did not read the lawsuit or the reasons for dismissal. The dismissal was not based on lack of evidence, but based on the party suing not having the qualifications of aggrieved status because obama had not been elected into office and the fact that the judge ruled that congress had jurisdiction over whether or not to enforce his eligibility. so that sir is vastly different than your invitation theory. Escariot is correct in repeating the reason why the law suit was dismissed. Lack of jurisdiction does not address the "merits" of the original lawsuit. However, the confirmation by the State of Hawaii that Obama was indeed born there does directly address the issue. There is no merit in the ascertion that Obama was not born in the U.S. At that point the issue should have gone away. Unfortunately, the conspiricists are attracted to it like a magnet. But basic socialism is simply the practice of sharing social costs across the population through taxes. Socialism can work well in highly capitalistic countries such as Germany, England, Australia, Canada, and many others. And it fails miserably under communism which is primarily a political system. When you pay for car, health, or life insurance you are paying for a socialized benefit through a privately owned company. The pool of subscribers is smaller which increases cost and a profit must be provided to the owners which also increases cost. From the perspective of the clients the costs of a benefit is spread across all of the fees paid by the other clients - socialism. Can it go too far, you bet. It went too far in Greece, Portugal, Italy, and others. It is not a science, it is an attempt by government to provide for its citizens. I believe that it goes too far when a family that can afford cell phones for all of the children, flat screen TV, and cable service can still be classified as poor.

Your financial aid information, your papers and thesis, your roommates, and even the activities and clubs you joined are not covered under the federal law that protects transcripts. If you ever have time go to the fec website and look at the payments payed by Barack to attorneys to keep records sealed. What I was able to find one weekend when i had the hours to do the research was the federal law concerning records and what is and what isn't covered. I then had looked up all the lawsuits concerning obama's eligibility based on citizenship. Thru those lawsuits i was able to see a long list of documents that were sealed and the plaintiffs were trying to gain access to. I also read about the 2008 fec expenses for the lawfirm Perkins and Coie. Those payments Michael were in installments of 200,000 and more for lawyers that represented him against over 30 eligibility lawsuits. Also Michael, if you look up the parameters of those 30 suits you will see the vast amount of data that he did in fact seal. That includes his selective service info, the college papers and financial aid info, information about his roommates, and lots of other documents. Do your own research Michael, then form an intelligent opinion. Before you do, please look at the extensive amount of information that is sealed and mysteriously dissapeared. You will find that all information regarding his original birth certificate concerning his grade school years has disappeared. The president of Occidental college remarked about the requests for obama's information. That is being done on the assertion that he applied there as a foreign student. Sorry I have been too busy with work and life to spent the time hunting down the urls for you.

FIFA is a hypocrite with zero credibility. He espouses gay marriage, yet voted for Obama when he was publicly in favor of traditional marriage. I never stated that i hated healthcare reform or that reform was not necessary. What i have always stated is that a systemic approach of entitlement reform and spending freezes need to take place first. There is no current program in place to address the addition of millions of patients with no increase in doctors or support staff to handle the increases without serious rationing of healtchare. I use the term liberals the same way that i use the term conservative. It is to describe political positions that are away from the moderate or independent. There are only 20 percent that identify themselves as either liberal or conservative, leaving the other 60 percent or majority of people suscribing to the middle or moderate point of view being likely to vote more on the person running and not the party they represent.

If you did, then you would have realized that I have equally criticized Bush for the Iraq involvement and his terrible fiscal messes such as medicare D and not paying for the wars while he was in office. I also equally criticized the scotus for the gore versus bush ruling and the obamacare ruling. I also posted on here that Romney has offshore accounts to limit tax liability, much in the same manner as Kerry docks his yacht in another state to avoid tax liability. I have also posted on here that Romney was a weak candidate compared to Jindal and Christie that I consider to be better candidates based on policy and accomplishments. I also stated that i do not believe in the Norquist pledge to not raise taxes and that the republicans bleeped up by not accepting the entitlement reform offer with the acceptable ratio of revenue increases. Too bad you base your posts on the fact that i disagree over same sex marriage and immigration reform and not on actual policies that i agree with concerning the democratic party. I have also typed that i am not pro-life and disagree with the conservative stance of telling a person in poverty to have a child then limit their resources to programs to raise a child they cannot afford.

I do not profess to be an expert on USA tax policies, nor am I a supporter of either Mr. Romney or President Obama. However, unless either is charged and convicted of tax fraud or other tax violations, I am going to assume that both men (and others mentioned above) have very smart tax experts who use the tax codes as written to the best advantage. If that is a crime, then the jails ought to be full of rich men and women. And I doubt that taking advantage of the complex tax policies in the USA is confined to conservatives or liberals. It is, however likely confined to people with lots of money (and influence). Unfortunately, I do not include my self in that latter category.
BTW, according to Roll Call, of the 20 richest members of Congress in 2011, 10 were Republicans, 10 were Democrats.

I just read on the CNBC website that Greece has rounded up 6000 illegal immigrants. They will be in the process of deporting them back to the country they came from. Greece is a country that is on the verge of bankruptcy but they are doing the right thing. They are protecting their legal citizens and getting rid of lawbreakers that are using their country's limited resources. The USA will be in the same predicament in the future. The USA deficit is almost 16 trillion dollars, that is $50,868.61 per citizen per the US National Debt Clock. We can't allow the unchecked illegal immigrants to flood this country. Any politician that is for returning these illegal immigrants to the country they came from will get my vote and my monetary support. Some Patch posters said the USA can't afford to send them back. Can the USA afford to use our tax dollars for illegal immigrants' free healthcare( emergency rooms), schools (K-12 grade), free school lunches, food stamps (if they have an American born child in the household) and jails (illegal immigrants committing crimes)?

Illegal aliens are granted equal protection of the law, and cannot be denied access to the same rights as legal citizens. Thus allowing them to be treated in emergency rooms just as all citizens. A single payer system would entitle all citizens the "right" of healthcare, and under the 14th amendment illegal aliens would also be such entitled entities to participate. So under his imagined single payer system, illegal aliens would have to be covered. (I guess by virtue of his status as a Constitutional scholar based on reading an article on About.com, he's able to predict not only exactly how a law establishing single payer would be written, but also how the Supreme Court would interpret its coverage.)
One nitpick with your prior post, however. Section 246 was actually part of the House Bill, but wasn't itself included in the as-passed Affordable Care Act. The section of the ACA that most closely resembles section 246 of the House Bill is section 1412(d), which provides that "Nothing in this subtitle or the amendments made by this subtitle allows Federal payments, credits, or cost sharing reductions for individuals who are not lawfully present in the United States." In addition, under section 1312(f)(3), persons not lawfully in the country are not eligible to purchase insurance through the Health Benefit Exchanges, EVEN IF THEY PAY THEIR OWN WAY. (But according to our resident Constitutional expert, that's probably unconstitutional, right Escariot? I wonder why no-one has challenged it. Maybe we should forward the About.com link to the ACLU!)

I stated that voters vehemently objected to a single payer system during the healtchare deliberations because illegal aliens would be entitled to those healthcare benefits if it was passed under the 14th amendment. I am still correct on this issue. I never stated that illegal aliens would be entitled to healthcare exanges or reforms under obamacare. Read much? The single payer system was on the table until it became clear that they could not get the votes to push it through the senate even with reconciliation. To deny illegal aliens the chance to purchase healthcare under the exchanges is not unconstitutional because it is not a right that every citizen has under the law. If the government goes to a single payer system that encompasses all citizens, then illegal aliens would be entitled to that same "right" under the 14th amendment. Unlike you Dawn P, i have lawyers in my family that are public defenders and actually hand immigration law cases. Maybe if you actually discussed these issues with an attorney you would a handle on what rights illegal aliens have even though not expressly delineated in the constitution but based on supreme court interpretations of equal protection under the law.

Have you actually read any of the cases on this issue, or are you relying solely on the about.com summary for your legal conclusions? (Don't answer, I already know you haven't read them.) The issue is not NEARLY as black and white as you make it out to be. Perhaps this is difficult for a non-lawyer to grasp, but the law is actually very nuanced and facts/details matter. If deciding whether something is Constitutional was a simple "if x, then y" proposition, we wouldn't even need courts -- we could just let computers decide cases based on checked boxes.
You can't pre-judge how the Supreme Court would decide on the Constitutionality of a law that hasn't even been written. The Kucinich Amendment would NOT have established a federal single payer system. It would have allowed waivers so that individual states could (each) establish their own single payer systems.
As for the Equal Protection clause, it absolutely does NOT mean that Congress or the States can't make distinctions between who they provide certain rights to and who they don't. (If it meant that, we'd already have marriage equality.) What it means, according to Supreme Court jurisprudence, is that when Congress or the states make distinctions between "classes" of people, those distinctions must be scrutinized to be sure that they are related to the purpose of the law. There are different levels of scrutiny, depending on the "right" at issue and/or the class of people affected. In Plyler v. Doe, the Court found that undocumented immigrants were not a "suspect class," nor was education a "fundamental right," either of which would have invoked the highest level of scrutiny. Instead, based on the importance of education and the fact that the Texas law specifically affected the CHILDREN of illegal immigrants, the Court applied Intermediate Scrutiny and found that the TX law was unconstitutional because it was not substantially related to an important governmental interest.
The Supreme Court has never said whether it would apply Intermediate or (the lower) rational basis scrutiny to laws that provide disparate treatment to undocumented adults. [continued...]

While I agree with a lot of those sentiments b allen, my focus for now resides in the way that liberals try "back door" processes to bring about things that congress and the voters would never approve of if made aware. The Kucinich amendment was a past (2009) attempt to get a single payer system into play while a more recent example is easy to mention. It is called the International Arms Treaty. If you read it as written, it would be superior to our own supreme court and constitution concerning the 2nd amendment to bear arms based on the supremacy clause of the constitution. It was an attempt through treaty to override the 2nd amendment without voters having any say on the loss of our sovereignty. Hillary and others claimed it would do no such thing and acted innocent. 51 senators, comprised of both dems and repubs sent a letter to Clinton stating they would boycott voting for the treaty unless it was expressly written into the treaty that our courts would have precedent over the un nations entity that would enforce the treaty. Mysteriously and magically, the treatly slated for vote on july 27th has not come back with the new language. Funny, if the bill never overrode the constituiton in its original language, then it would have taken 30 seconds to add that little addendum. Instead, it is August 8th and no treaty has come forward with the changes.

Further, it's a bill on the ballot. It is NOT yet law. No ignorance on my part. All this will serve to do is provide access to those who have not earned it; i.e. they are not citizens of Maryland. My 4 children are at risk of being bumped when applying to our area colleges, yet having equal qualifications. I'm seeing it already at places like UMBC, who have been operating this way long before this bill his Annapolis. See below:

So if a adult speeds or drives without a licence (a similar, civil infraction) then the child in the backseat should be charged with breaking the law as well??? Can you explain the logical, ethical, practical, or economic reasoning behind such a backwards viewpoint, please????
The alternative of demanding these in-state children of tax-filing parents be encouraged to NOT attend in-state schools is, obviously, remarkably short-sighted. Would I rather these kids go to college and realize their potential as educated, productive, tax-paying members of society or would I rather demand that they be forced into the underclass, pay less in taxes, and consume more in govt. services? The answer to that is clear and obviously to anyone who comes to the debate unadulterated by nonsensical misconceptions and fears (e.g. your rant about UMBC - that blog post supports the opposite of what you're saying, btw).

The ignorance and hate expressed by some bloggers is disgusting - on both sides. Some on the left don't want to recognize that there is a problem and some on the right don't want to recognize that these are human children. Children raised in America as Americans. Some want to threaten these children and take away whatever dignity they can strip from them.
Whatever makes Americans an American has little to do with where they come from, what language they speak, what religion they have, their color, or their ethnicity. What makes Americans American is their support for and defense of the Constitution of the United States.
As an American you must accept that "all Men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the Pursuit of Happiness." That is the Constitution that defines America.
Many of the early immigrants came here to escape poverty, religious and political persecution, or other conditions that robbed them of those inalienable rights. As did the parents of these children.
Yes, we need to do a better job at controlling our borders. As a nation, we have a right to limit immigration. However, the children identified in the Dream Act are as American as our children except for where they were born. These children are here and want to be Americans. Wouldn't be easier and less expensive for everybody to stop discriminating against them and, rather, provide a path to citizenship?
