Update: Parkville Man Receives 2 Life Sentences for Murders of Pregnant Girlfriend, Her Daughter

Brian Eggleston pleaded guilty to charges related to the June 2011 incident in November 2012.

(Update 1:33 p.m.)—Parkville resident Brian Eggleston was sentenced on Wednesday to two consecutive life sentences with the possibility of parole in the shooting deaths of his pregnant girlfriend and her 4-year-old daughter. 

"It was a senseless murder," said Baltimore County Circuit Court Judge Mickey Norman, ahead of delivering Eggleston's sentence.

Alicia Avery, 25, and her daughter Darry'el Parker died from gunshot wounds to the head on June 24, 2011. Police discovered their bodies two days later at a Welcome Inn apartment, at 8729 Loch Bend Drive, where Alicia Avery lived through her involvement in the witness protection program in connection with a Baltimore City murder.

Eggleston, 29, pleaded guilty to two counts of first-degree murder on Nov. 26, 2012.

Before the sentencing hearing, Eggleston attempted to withdraw his guilty plea, arguing that he felt he had no choice but to take the plea without the option of a trial, citing failure on the part of his lawyers and noting the fact that the gun used in the murders was not found.

Norman declined the request, countering that the state had ample evidence in its case such as shell casings from the gun found at the scene, and said the actual weapon was not needed. He added that he rejects the argument that Eggleston did not understand his right to a trial, saying that jury selection was underway when the Parkville man made his plea.

Norman further noted that the alleged ineffectiveness of Eggleston's attorneys had no bearing on the sentencing hearing. The judge told him that he could pursue court action on that matter at a later date.

Defense attorney Jerome Joyce pointed to Eggleston's troubled childhood with parents who were "seriously involved" with drugs and alcohol and possible mental illness, including depression coupled with suicidal inclinations, in an attempt to garner leniency for his client. He called the murders an "aberration."

"There's no history of violence in his life," Joyce said.

Prosecutor Robin Coffin argued that Eggleston killed Alicia Avery and Darry'el Parker because "he didn't get his way" after Alicia Avery made the decision to end their relationship and move to a different location.

The two had a history of of arguing, according to charging documents.

"This man executed those two," Coffin said.

April Avery, mother of Alicia Avery, wept openly as she testified before Norman.

"My daughter was everything to me," said April Avery, noting that Alicia Avery was pregnant with twins by Eggleston at the time of her death. "I didn't get to hold her one last time. There was a special place in my heart for her and my granddaughter."

Darryl Parker, father of Darry'el Parker, lamented having lost the opportunity to watch his daughter grow up in his testimony.

"No more birthdays, no more holidays ... all spent at a grave site," Parker said.

Eggleston spoke briefly before the sentence was handed down.

"Just want to say, I'm sorry for the loss. That's it," he said.

Coffin said Avery's family members, who packed the right side of the courtroom, were pleased with the sentencing.

"Of course they suffered a tremendous loss, but they felt justice was served," she said.

I am so sorry he had a troubled childhood, but many people have a troubled childhood and never consider solving a problem by shooting a child in the head. I am so sorry he doesn't understand those of us who have no sympathy for him. I am so sorry he is such a sorry man.
