Tom Kiefaber, the former owner of the Senator Theatre, received probation before judgment as part of a plea deal on second-degree assault and harassment charges on Wednesday in Baltimore District Court. As part of the plea deal, Kiefaber is placed on unsupervised probation for a year, must show proof that he has completed an anger management course, stay away from the Senator Theatre and abstain from any contact with its current owners. The trial date for Tom Kiefaber, who is facing charges including second-degree assault and trespassing, has been postponed until Nov. 5. A Baltimore City District Court judge ordered the trial delayed because the assault charge, which was placed on the stet docket following an incident last year, was just reopened at the behest of the state. Kiefaber also told the judge that he needed time to arrange for a public defender because he is "indigent" and "basically homeless." He would also say in court that the charges were an attempt to harass a private citizen who was advocating for the Senator Theatre. "This is all just basically a show," Kiefaber said. There’s a new plot twist in the melodrama of the historic Senator Theatre. The theater will be sold to its current operators, James "Buzz" Cusack and his daughter and business partner Kathleen Cusack, according to Joanne Logan, a spokeswoman for the Baltimore Development Corp. The Baltimore Business Journal first reported the quasi-governmental agency Baltimore Development Corp. is in the process of putting the deal together to be presented to the Board of Estimates. The development corporation contracts with the city to provide "economic development services," according to its website. Tom Kiefaber, the former owner of the Senator Theatre and City Council President candidate, was arrested for trespassing on Monday, according to Baltimore City police. Anthony Guglielmi, a police spokesman, confirmed via email that Kiefaber had been arrested. Maj. Sabrina Tapp-Harper, commander of the Northern District, said that Kiefaber was arrested at the Senator Theatre, 5904 York Road, at about 10 a.m. Monday. Tapp-Harper, who was not at the scene, said the supervisor that was there at the time of the arrest reported Kiefaber allegedly made threats to harm people inside the building, but could not confirm what exactly he said. On Tuesday, the Commission for Historical and Architectural Preservation voted to allow developers to use “golden rod” brick for the planned renovations of the historic art deco movie theater. But the commission added the caveat that it makes an on site visit within next two month to review the work. The Senator Theatre will close on Friday for up to nine months for renovations, according to the Baltimore Business Journal. The renovations of the historic art deco theater are expected to cost about $3 million and will include restoring the main auditorium and adding three new screens to the building that opened in 1939. James “Buzz” Cusack and his daughter Kathleen Lyon took over operation of the theater about a year and a half ago, and are expected to invest about $900,000 in the project. The operators of the Senator Theatre placed an announcement on their Facebook page Wednesday regarding the status of the rehab of the landmark. According to the announcement, the operators have building permits from the city in hand, and have hired A.R. Marani Inc. to build the additional theaters. James “Buzz” Cusack and his daughter Kathleen Lyon took over the operations of the theater about a year and half ago. The state has awarded the Baltimore Development Corporation $300,000 for the rehabilitation and restoration of the Senator Theatre. The Maryland Department of Housing and Community Development announced $1.4 million in Community Legacy Program Awards for projects in Central Maryland on Wednesday, according to a news release. Last week the state announced the theater would be receiving $300,000 in historic tax credits to aid in the renovation of the theater.
